Reason #1

The Mexico and Caribbean Vacation Clubs Do Not Own The Units

When you attended a “timeshare presentation” in these regions and purchased, you signed with a different company than the resort owner. The timeshare company does not own any of the rooms nor any part of the resort property, but make reservations for their members with the resort like any other “travel agency.” 

Reason #2

Most of the Mexico or Caribbean Vacation Clubs Do Not Have Business Licenses to Legally Operate

If you review your contract carefully, you will notice that the vacation club  does not provide any legal information about their business, i.e. tax I.D., legal business owners, corporate I.D. or anything else that proves that they have a business license to sell vacation club memberships in those cities. Call them and request this information. Then call the local business authorities to verify. Nothing.

No Legal Representative of the Vacation Clubs Ever Signs the Paperwork.

For a contract to be legal, both parties must sign.  None of the marketing, sales, or contract staff work for the vacation club organization. They work for a separate company called a “pagadora,” a company that simply pays their commissions. There is no written contract between the staff and the vacation club that states that they represent the vacation club. 

 

Moreover, if you review the signatures in your documents,  there are no names attached to them.  They are merely scribbles, and there are no names attached to the scribbles. This releases the vacation club from any “wrongdoings.”

Reason #4

The Mexico and Caribbean Vacation Clubs Do Not Have Access to American or Canadian Credit Reporting Agencies

If you check your most recent credit report, your Mexico or Caribbean vacation club membership does not appear for two reasons… (1) These regions do not have credit reporting agencies. (2) They cannot subscribe to U.S. or Canadian credit reporting agencies. The agencies are solely meant for U.S. or Canadian businesses only.

 

Moreover, they cannot “legally” use a U.S. or Canadian collection agency to collect on any debt that was signed in their country. 

 

Here’s a red flag. Many contracts state their contract jurisdiction in Panama while the contracts were signed elsewhere.
